These Terms of Service ("Terms") govern your access to and use of the website baeicargobd.com and the freight forwarding, brokerage and logistics services (the "Services") provided by BAEI Cargo LLC, a New Jersey limited liability company ("BAEI Cargo", "we", "us"). By accessing the Site or engaging our Services you agree to these Terms.
BAEI Cargo acts as a licensed property broker and non-vessel-operating common carrier (NVOCC). Unless expressly stated in a shipment contract, we arrange transportation with third-party motor carriers, ocean carriers and air carriers; we do not physically transport the goods ourselves.
All quotes are valid for seven (7) calendar days and are subject to space, equipment availability, fuel surcharges published on the date of pickup, and correct commodity/weight declarations. Rates may be adjusted if actual freight differs from the description provided at quoting.
Liability of BAEI Cargo and its underlying carriers is governed by the applicable convention or statute for the mode of transport, including the Carmack Amendment (49 U.S.C. §14706) for domestic road freight and COGSA / Hague-Visby for international ocean movements. Our standard liability, unless additional shipper's-interest cargo insurance is purchased, is limited to $0.50 per pound for ocean and $9.07 per pound (or 22 SDR/kg) for air, or as otherwise stated on the applicable bill of lading or air waybill.
We strongly recommend purchasing all-risk cargo insurance. Contingent cargo coverage held by BAEI Cargo is not a substitute for a shipper's own policy.
Invoices are payable in U.S. dollars via ACH, wire or company check per the terms shown on each invoice. Late invoices accrue interest at 1.5% per month or the maximum permitted by law. We reserve the right to hold shipments for unpaid invoices under our general lien.
Neither party is liable for delay or non-performance caused by events beyond reasonable control, including weather, strikes, government action, port congestion, cyberattacks, pandemics or war.
We do not transport illegal drugs, weapons, unmanifested currency, live animals, or any goods restricted under U.S. or destination law.
All content, trademarks and logos on the Site are the property of BAEI Cargo or its licensors. You may not copy or reuse them without written permission.
These Terms are governed by the laws of the State of New Jersey, without regard to conflict-of-laws principles. Exclusive venue for disputes lies in the state and federal courts located in Burlington County, New Jersey.
